Appeal from a decision and order of the Supreme Court, Oneida County (Bernadette T. Clark, J.), entered October 2, 2022. The decision and order denied the motion of defendant Faxton-St. Luke's Healthcare for summary judgment, granted the motion of Fairbrother Property Management for summary judgment dismissing plaintiff's claims and the cross claims of Faxton-St. Luke's Healthcare for contribution and contractual indemnification, denied the motion of Fairbrother Property Management for summary judgment on the cross claim of Faxton-St. Luke's Healthcare for common law indemnification and denied the motion of plaintiff for prohibition pursuant to CPLR 3126. Faxton-ST Luke's Healthcare (FSLH) owned and operated a hospital at 807 Newell Street, Utica. FSLH contracted snow plowing services from Fairbrother Property Management (Fairbrother). On January 7, 2017, plaintiff Gayle Bunn sustained personal injury when she slipped and fell on ice on the hospital property. Defendants each moved for summary judgment, and plaintiffs moved to prohibit certain evidence at trial on the ground of spoliation. FSLH and plaintiffs appeal.
