Appeal from an order of the Supreme Court, Erie County (Timothy J. Walker, A.J.), entered August 9, 2022. The order, among other things, granted plaintiff's cross motion to amend the amended complaint in part, to the extent that plaintiff may amend the amended complaint to assert causes of action for breach of contract, negligence, negligent misrepresentation, promissory estoppel, and contractual indemnification and denied defendant's motion to dismiss the amended complaint.
