Appeal from a judgment of the Supreme Court, Monroe County (Joanne M. Winslow, J.), rendered July 14, 2015. The judgment convicted defendant, upon a non jury verdict, of criminal possession of a controlled substance in the third degree (two counts), criminal possession of a controlled substance in the fourth degree, criminal possession of marihuana in the third degree and criminally using drug paraphernalia in the second degree (two counts). Defendant was indicted on eight counts after a search warrant was executed at 26 Frick Street, Rochester. Defendant was found hiding in the attic. Defendant was sentenced, as a second felony drug offender, to concurrent terms, the greatest of which is two years with two years postrelease supervision. On July 15, 2015, defendant was resentenced to the same aggregate term.
