Appeal from an order of the Supreme Court, Erie County (Dennis E. Ward, J.), entered January 7, 2022. The order denied the motions of plaintiffs for summary judgment on negligence and determined that the reckless disregard standard applies; denied the motions of defendants City of Buffalo, Buffalo Police Department and Brandon D. Lowe for summary judgment on reckless disregard; denied the motion of said defendants to dismiss on the ground of governmental immunity; granted the motion of said defendants to remove Buffalo Police Department as a named defendant; denied the motions of plaintiffs to dismiss affirmative defenses of reckless disregard exemption and the emergency doctrine; granted the motions of plaintiffs to dismiss affirmative defenses of noncompliance with General Municipal Law § 50-e, failure to mitigate damages, failure to name a necessary party, sovereign immunity, lack of standing, no special duty and lack of jurisdiction; and granted the motion of plaintiff for summary judgment on serious injury.
