Appeal from a judgment of the Supreme Court, Monroe County (Alex R. Renzi, J.), rendered May 12, 2012. Defendant was resentenced upon his conviction of attempted robbery in the third degree. On August 27, 2005, defendant, armed with a firearm, entered the residence of Brian and Ashley Eckman at 1341 Park Avenue, Rochester, and stole money from them. Thereafter, defendant tried to steal money from the East Avenue Liquor Store. Defendant was convicted for robbery in the second degree, burglary in the second degree (two counts) and attempted robbery in the third degree. Defendant was sentenced, as a persistent violent felony offender, to concurrent and consecutive terms aggregating to 40 years to life. This Court affirmed (KA06-1104; 56 AD3d 1300, lv denied 11 NY3d 923; RH NS G [P] JG). On defendant's CPL 440.20 motion, Supreme Court ordered resentencing on attempted robbery. Defendant was sentenced to a consecutive term of two to four years. This Court reversed and remitted for resentencing and ensuring that defendant is afforded his right to counsel (189Ad3d 2153; KA 13-1552; 1181/20; EC L [JC] JW D). Defendant was resentenced, as a second felony offender, to a concurrent term of 1 1/2 to three years.
