Appeal from an order of the Supreme Court, Erie County (Mark A. Montour, J.), entered March 25, 2021. The order granted the motion of defendant for summary judgment, denied the cross motion of plaintiff for summary judgment and dismissed the complaint. Plaintiff rented a cottage in Irving from defendant. On July 27, 2018, plaintiff sustained personal injury when the deck on which he was sitting collapsed. Supreme Court found that defendant established a lack of notice of a dangerous condition and that she did not create the condition, and that plaintiff failed to raise an issue of fact.
