Appeal from an amended decision and order of the Supreme Court, Erie County (Deborah A. Chimes, J.), entered August 3, 2020. The amended decision and order, insofar as appealed from, deferred plaintiff's motion for the assessment of damages against defendant. Plaintiff alleges that he was sexually assaulted by defendant James Jackson, an employee of the Young Men's Christian Association, Buffalo Niagara (YMCA), between January 1, 1992 and sometime in 1999. Supreme Court granted plaintiff a default judgment but delayed the assessment of damages until the disposition of LG 46 v YMCA. Plaintiff appeals.
