Appeal and cross appeal from an order of the Supreme Court, Erie County (Joseph R. Glownia, J.), entered May 13, 2020. The order, insofar as appealed from, denied the motion of third-party plaintiff for summary judgment and denied the cross motion of third-party defendant to dismiss the third party complaint. Defendant Buffalo Housing Authority (BHA), along with other defendants (collectively, Waterfront), owned an apartment complex on Niagara Street, Buffalo, which was the sire of a construction project. The construction manager subcontracted framing work to defendant-third party plaintiff S.A.B. Specialties, LLC (SAB), which subcontracted work to third-party defendant Blas Zuniga Builders, LLC (Blas), the employer of plaintiff. On January 19, 2016, plaintiff sustained personal injury when he fell from a ladder. Supreme Court granted plaintiff partial summary judgment pursuant to Labor Law § 240 (1) and denied DAB's motion for dismissal of the complaint. Waterfront and Blas appeal (appeal 1). The court also denied SAB's motion for summary judgment on indemnification against Blas and denied the motion of Blas to dismiss the third party complaint. Waterfront and Blas appeal (appeal 2).
