Appeal from a judgment of the Supreme Court, Monroe County (Thomas E. Moran, J.), rendered June 16, 2014. The judgment convicted defendant, upon a jury verdict, of robbery in the first degree, robbery in the second degree and criminal possession of a weapon in the second degree (two counts). On December 29, 2012, defendant, Terrance Lawhorn and Savon Tolbert-Howard robbed the Vintage Hair Gallery on South Clinton Avenue, Rochester. Defendant and Lawhorn were tried together. Lawhorn was convicted of robbery in the first degree and robbery in the second degree and on appeal this Court reverssed Lawhorn's conviction (see People v Lawhorn, 178 AD3d 1466 [4th Dept. 2019]; 1309/19; KA 14-1614; W EMP D T [B). Defendant was convicted of robbery in the first degree, robbery in the second degree, and criminal possession of a weapon in the second degree (two counts). Defendant was sentenced to concurrent terms of imprisonment the longest of which was a determinate term of 25 years with five years postrelease supervision. Defendant was subsequently resentenced as a second violent felony offender, but does not appeal the resentence.
