Appeal and cross appeal from an order of the Supreme Court, Erie County (Donna M. Siwek, J.), entered August 12, 2020. The order, insofar as appealed from, denied the motion of plaintiffs for summary judgment with respect to serious injury, granted the motion of defendant for summary judgment dismissing the complaint of plaintiff Annmarie Engle and granted in part the motion of defendant for summary judgment against plaintiff Christopher Engle on the issue of serious injury.
