Appeal from a decision and order of the Supreme Court, Onondaga County (Gerald J. Neri, J.), entered May 13, 2020. The decision and order, insofar as appealed from, granted petitioner's request for mandamus requiring respondent to review and act on an incentive proposal. As part of its Master Plan for the development of the Syracuse Inner Harbor, petitioner (COR) is the developer of a two-building mixed use development on Van Rensselaer Street, Syracuse. In April 2016, respondent (ESD) offered COR a incentive proposal of $2,500,000, subject to several conditions. COR accepted and executed the proposal. On May 17, 2019, ESD withdrew the proposal. COR commenced this proceeding on September 12, 2019, seeking to annul the withdrawal and to compel approval of the proposal. Supreme Court granted mandamus to the extent of requiring ESD to act on the proposal, but otherwise denied relief. ESD appeals.
